O Brasil em meio à corrida regulatória pela governança da economia digital

Investiga-se, neste artigo, como o governo brasileiro participa das negociações envolvendo comércio digital com vista a sua regulação nas esferas multilateral, regional e bilateral, à sombra dos principais modelos regulatórios estrangeiros em competição. O artigo documenta como a posição brasileira é constituída e reconstituída e quais fatores determinam tais mudanças. Argumenta-se que a abordagem brasileira à regulação de comércio digital mudou substancialmente depois de 2018. Se, até 2018, a abordagem brasileira era defensiva e fortemente determinada por sua agenda de governança nacional de Internet, atualmente, a posição do Brasil é substituída por uma abordagem mais liberal à regulação do comércio digital, mais próxima do modelo regulatório dos Estados Unidos. Essa nova abordagem inspirou o Brasil a aprovar dois novos acordos de comércio: o Acordo de Livre Comércio entre Brasil e Chile e o Acordo sobre Comércio Eletrônico do Mercosul. Trabalha-se com a hipótese de que essa mudança de posição está calcada em uma orientação deliberada de política externa do governo brasileiro de alinhamento aos Estados Unidos, sob a liderança do Ministério da Economia do Brasil, afetando as estratégias de negociação de regras de comércio, inclusive digital, e induzindo reformas nacionais no setor. Este artigo combina revisão de literatura especializada e de policy papers, análise de documentos primários e entrevistas com representantes do governo brasileiro.
