Une illustration du droit global, la lex mercatoria climatique ?

Cette contribution a pour objet de montrer comment un droit typiquement global, la lex mercatoria, pourrait contribuer à lutter contre le réchauffement climatique. Ce droit viendrait compléter l’action normative des législateurs nationaux et internationaux en intégrant une dimension climatique dans les relations contractuelles économiques transnationales. Militant pour l’avènement d’une lex mercatoria climatique, notre contribution plaide ainsi pour les vertus d’un droit global entendu comme celui créé par les volontés individuelles des entreprises acteurs non étatiques et régulant des relations privées de manière interdépendante et en circulation dans un espace juridique volontairement inoccupé par les droits étatiques et interétatique.Downloads
