O exercício da jurisdição interamericana de direitos humanos: legitimidade, problemas e possíveis soluções

O trabalho enfrenta a questão da legitimidade e, consequentemente, efetividade das decisões da Corte Interamericana de Direitos Humanos. Corriqueiramente a literatura especializada investiga o problema sob a ótica interna. Contudo, esta pesquisa direciona a investigação para possíveis causas internacionais da questão. Partindo de um estudo comparado de caso, um enfrentado no continente europeu e o outro no americano, e através de um método descritivo e normativo, o trabalho identifica pontos problemáticos na jurisprudência da Corte interamericana ao estabelecer o sentido e extensão das normas de direitos humanos. O objetivo é trazer informações e argumentos que possibilitem uma reflexão crítica da atuação da Corte e seu impacto na efetivação dos direitos humanos. São esboçadas duas soluções aos problemas. Uma delas é encontrada na jurisprudência do Tribunal Europeu dos Direitos do Homem e a doutrina da margem de apreciação. A outra é fruto da doutrina e de dois casos paradigmáticos da própria Corte interamericana.References
