International parental kidnapping: the habitual residence principle

The present study is to demonstrate the importance of the Hague Convention on the Civil Aspects of Interparental Kidnapping from 1980 on children’s rights and clarify what is the definition of the principle of residence used by the members of the Convention. The work is classified as a literature in which data were obtained through literature searches. Books, articles published on the internet, magazines, newspapers and others exhibitions of Brazilian law and the Hague Convention on International Child Abduction were used as research material.
