Discussões biotecnológicas quanto aos organismos geneticamente modificados no âmbito da OMC: do contencioso ao acordo de vontades entre Argentina e União Europeia

O estudo evidencia a relação entre direitos humanos, proteção ambiental e direito do comércio internacional a partir do contencioso entre Argentina e União Europeia sobre as restrições a importação de Organismos Geneticamente Modificados, no âmbito do Órgão de Solução de Controvérsias da Organização Mundial do Comércio. Verifica, por meio do exame de entraves e soluções, necessária convergência de entendimentos em relação à biotecnologia, para devida consistência e eficácia da preservação de um meio ambiente equilibrado. Valer-se-á da abordagem qualitativa, analisando pontos centrais sobre o caso, especialmente no que tange a análise de riscos e tomada de decisões frente ao princípio da precaução. Para tanto, faz-se necessária a apreciação das petições submetidas, relatos do Painel estabelecido e ajustes realizados entre as partes envolvidas. O Acordo sobre Agricultura, o Acordo Geral sobre Tarifas e Comércio, o Acordo sobre a Aplicação de Medidas Sanitárias e Fitossanitárias e o Acordo sobre Barreiras Técnicas ao Comércio, bem como doutrina especializada, também serão objetos de apreciação para o desenvolvimento da pesquisa.References
