O Trans-Pacific Partnership Agreement e seus potenciais impactos para a regulação da biodiversidade no âmbito transnacional

O presente artigo visa a discutir os potenciais reflexos que as alterações normativas e a entrada em vigor do Trans-Pacific Partnership agreement (TPP) podem ensejar no plano do sistema jurídico internacional existente para a proteção da biodiversidade. Devido à escassez de material bibliográfico produzido sobre o assunto, sobretudo em razão de que o tratado foi assinado no mês de fevereiro de no ano corrente e carece de análises acadêmicas aprofundadas sobre as agendas transversais ao comércio e ao investimento, foram utilizadas fontes midiáticas, bem como a metodologia comparativa, considerando o marco existente no âmbito de outros acordos bilaterais e regionais de comércio, bem como de investimentos e os impactos que trouxeram para os acordos multilaterais e matéria ambiental. O artigo estrutura-se na análise de três eixos, a saber, da tendência em transversalizar a agenda ambiental no âmbito da cooperação comercial e da proteção aos investimentos estrangeiros, no exame do capítulo do TPP destinado ao meio ambiente e, finalmente, na análise de seu mecanismo de solução de controvérsias. Conclui-se que, ao menos do ponto de vista da retórica e da técnica legislativa utilizada, o TPP pode representar um retrocesso quanto à efetivação dos deveres assumidos pelos Estados partes no marco de outros acordos.References
