Na ordem jurídica brasileira a extradição reponta em mais de um tópico da Constituição Federal, sendo regulada no plano ordinário pelo Estatuto do Estrangeiro e pelos tratados internacionais que comprometem o Brasil ___ entre estes o compromisso bilateral com a Itália, vigente desde 1993. A própria Carta dispõe sobre o instituto em quatro oportunidades: ao vedar, no rol de garantias, a extradição de brasileiro e do acusado de crime político ou de opinião; ao atribuir à União a competência privativa para legislar sobre a matéria; e ao reservar à competência originária do Supremo Tribunal Federal o processo e julgamento da extradição solicitada por Estado estrangeiroReferences
