A teoria ambientalista (Green Theory) e a competência consultiva da Corte Interamericana de Direitos Humanos: o caso da Colômbia

O presente artigo tem como propósito traçar um paralelo entre teoria e prática, sendo que o plano teórico é elucidado por meio de estudos à teoria ambientalista (green theory), ao passo que o plano prático é vislumbrado através da mais recente consulta, no âmbito do sistema interamericano de proteção aos direitos humanos, feita pela Colômbia à Corte Interamericana. A hipótese do trabalho, que encontra eco em variados autores, é a de que a teoria ambientalista pode ganhar vida e se fazer presente no plano prático. As fontes ora utilizadas são multidisciplinares, como assim é interdisciplinar o tema meio ambiente, contudo, o trabalho não pretende dar respostas prontas, até mesmo porque a própria consulta da Colômbia ainda se encontra em tramitação na Corte Interamericana de Proteção aos Direitos Humanos. A hipótese do presente artigo é a de demonstrar a importância da teoria ambientalista dentro do direito internacional, especialmente no Sistema Interamericano de Proteção aos Direitos Humanos.
