La progressive harmonisation des règles du procès environnemental : manifestation de l'émergence d'un droit global ?

Parce que certains risques environnementaux manifestent aujourd’hui un caractère global et irréversible, défiant les frontières du temps et de l’espace, ils bousculent la nature a priori locale du litige environnemental. Cela invite le juriste à s’interroger sur la spécificité, l’adaptabilité et l’efficacité du procès face à l’objectif de protection de l’environnement. Il semble que, partout dans le monde, la cause environnementale soit en train de bousculer les règles du procès en les mettant à l’épreuve de certaines questions inédites qui défient le temps tout autant que les frontières juridiques et spatiales au travers de la complexité technique et juridique, de l’incertitude scientifique, et surtout du « global ». Peut-on affirmer qu’il existe-t-il une circulation des normes relatives au procès en matière environnementale ? Pour essayer de répondre à cette question, nous étudions en amont de l’instance la question de l’accès au juge en matière d’environnement et nous constatons ainsi une diffusion progressive du droit au juge. Nous nous intéressons ensuite aux règles relatives au déroulement de l’instance, et spécifiquement celles, centrales, qui régissent l’administration de la preuve pour constater ici aussi une certaine harmonisation au nom de la spécificité des contentieux environnementaux.Downloads
