Vinculação dos direitos econômicos, sociais e culturais: uma discussão do desenvolvimento humano com base no conceito de Amartya Sen sobre o mínimo existencial

Procura-se discutir o que são os Direitos Econômicos, Sociais e Culturais (DESC), tanto na sua aplicação internacional quanto regional, com foco nos tratados internacionais, para demonstrar a vinculação de responsabilidades assumidas pelos Estados partes, fiscalizados por meio de mecanismos de controle internacionais e pelo controle de convencionalidade nacional. Em seguida, demonstra-se a natureza fundamental de tais direitos através de respostas às críticas quanto a sua força vinculante e exequibilidade. Fundamenta-se, através da pesquisa bibliográfica qualitativa, a análise doutrinária e econômica sobre os DESC por meio da Teoria das Capacidades de Amartya Sen, onde se discute a relação entre o social e o financeiramente possível, justificado pelo conceito de mínimo existencial. Por fim, faz-se uma relação entre realizações individuais, identidade e desenvolvimento social, através do diálogo público propiciado pelo aumento de liberdades, as quais são responsáveis por proporcionar capacidades para atingir os funcionamentos, as realizações.Downloads
