A galáxia lex e a construção de um sistema jurídico transnacional

Em um mundo cada vez mais globalizado, os ordenamentos estatais não têm sido considerados como as únicas fontes de normatividade. A doutrina jurídica tem rechaçado cada vez mais a concepção dita westfaliana do direito, em que a exclusividade de produção normativa é da figura do Estado. Assim, têm-se no pluralismo jurídico e na transnacionalidade novas fontes de regulação que pretendem suprir os anseios dos setores sociais, que a cada dia especializam-se mais. Dessa onda de especialização proveniente da globalização surge o termo galáxia lex, que seria o conjunto de ordens transnacionais, aduzindo o presente estudo que tal galáxia possui a tendência de tornar-se global, no sentido de coesa e cooperativa para dirimir conflitos intersistêmicos. Com fulcro no método hipotético dedutivo e através de levantamento bibliográfico da melhor doutrina a respeito, propugna-se a urgência da construção de um ordenamento jurídico transnacional, a galáxia lex.Downloads
