Nacionalidade: novas regras, velhos problemas

Este artigo visa analisar as lacunas e deficiências do sistema jurídico brasileiro concernente à nacionalidade. Embora a Constituição Federal tenha um capítulo específico sobre o assunto, regulado por normas infraconstitucionais, com destaque para a Lei de Migração (Lei 13.445/2017), existem problemas que merecem maior atenção de constitucionalistas e internacionalistas no Brasil. Elegeram-se como temas para análise mais específica o direito à nacionalidade de estrangeiros adotados por brasileiros; a extradição de brasileiros naturalizados por tráfico de drogas superveniente à naturalização; o conceito de atividade nociva, requisito necessário ao cancelamento da naturalização; e a diferença entre “cancelamento” e “declaração de nulidade” de naturalização”. A investigação tem natureza qualitativa e exploratória amparada em fontes primárias, bibliográficas e no direito comparado. Ao final, conclui-se: a Constituição brasileira necessita ser atualizada no tocante à nacionalidade decorrente de adoção transnacional; os constituintes brasileiros não tiveram bom senso nem adotaram boa técnica legislativa no tratamento do cancelamento da naturalização em virtude de tráfico de drogas; faltam padrões normativos claros definidores de atividade nociva, o que pode acarretar cancelamento arbitrário da naturalização.References
