Um TWAILer entre nós? Desvendando as contribuições de Celso Duvivier de Albuquerque Mello para o Direito Internacional (crítico) no Brasil

O presente artigo analisa a trajetória e parte da obra de Celso Duvivier de Albuquerque Mello no contexto de uma suposta tradição brasileira de direito internacional. Mello teve uma produção acadêmica extensa e qualificada, dedicando-se aos mais variados temas do direito internacional. Além da academia, atuou como juiz do Tribunal Marítimo. Levando-se em conta suas principais obras em direito internacional econômico (DIEc), sugere-se que Mello se alinhou com abordagens críticas ao direito internacional, sobretudo com o que na década de 1990 se convencionou chamar de Abordagens de Terceiro Mundo do Direito Internacional (TWAIL, sigla em inglês). A partir da análise das referências bibliográficas de suas obras de DIEc, observa-se que Mello foi fortemente influenciado pela produção europeia no campo, sobretudo a francesa, sem que isso tenha reduzido o potencial crítico de suas ideias. Em seguida, o artigo investiga o impacto da obra de Mello na academia, nos tribunais superiores e nos pareceres dos consultores jurídicos do Itamaraty. O artigo também é permeado pela análise dos prefácios das quinze edições do seu Curso de Direito Internacional, espaço onde o autor deixava fluir mais livremente sua visão de mundo e seus sentimentos. Conclui-se que Mello alcançou um lugar de destaque na história do direito internacional brasileiro, contribuindo especial e singularmente com abordagens de Terceiro Mundo ao Direito Internacional desde o Brasil. O artigo empregou metodologia de pesquisa empírica, combinando uso de entrevista com análise de documentos primários e secundários acerca da vida e obra de Celso Duvivier de Albuquerque Mello.References
