Com o fim da Guerra Fria, a sociedade global foi confrontada com reivindicações de ordem cultural e identitária que instauraram uma nova tensão entre os princípios da igualdade jurídica e da diferença cultural. Os Estados desfavorecidos e aquelas minorias que se sentem estigmatizadas, como os povos autóctones, os grupos étnicos e as mulheres, agora aspiram ao reconhecimento da sua igual dignidade, mas também suas identidades e seus direitos particulares, sendo que algumas delas aspiram, inclusive, a reparação pelas injustiças decorrentes da violação das suas identidades e do confisco de seus bens e de suas terras. Para dar conta destes novos tipos de reivindicações, os atores da sociedade internacional desenvolveram um novo ramo do direito: o direito internacional do reconhecimento. O objetivo deste artigo é destacar esta evolução, identificar as práticas jurídicas relacionadas com este novo direito internacional do reconhecimento e submeter os seus pressupostos e implicações à análise crítica.Downloads
