A interpretação evolutiva da Convenção Americana sobre Direitos Humanos: análise quantitativa e qualitativa do período 1988-2018

O presente artigo abordará a prática do critério de interpretação evolutiva da Convenção Americana sobre Direitos Humanos na Corte Interamericana de Direitos Humanos. A pesquisa empírica foi feita nos casos contenciosos e nas opiniões consultivas editadas em um período de 30 anos (1988-2018). O texto cria categorias analíticas para avaliação comparativa desse critério interpretativo: 1) Fundamento da evolução; 2) Objeto da evolução; 3) Parâmetro da evolução e 4) Balizas da Interpretação. Argumentamos que mudanças na composição da corte e a consolidação democrática são fatores que explicam a mudança de jurisprudência da corte em 2016, a qual passa a dissociar a proteção mais ampla da pessoa da interpretação evolutiva, binômio que explicava a prática anterior (1999-2016).References
