Como consequência, o campo do Direito Internacional testemunha uma série de publicações acadêmicas que analisam os recentes movimentos populistas e seus impactos no Direito Internacional como nós o conhecemos. Essas análises focaram em diferentes áreas do Direito Internacional e suas instituições, como comércio, meio ambiente, direitos humanos, trabalho e migração. Através destes distintos contextos, o populismo tem sido equiparado ao autoritarismo, e visto como um desafio fundamental para uma ordem jurídica internacional liberal. Além disso, o Direito Internacional é frequentementeretratado de forma binária/antagônica, seja como uma ferramentapara banir políticas populistas ou como um instrumento para permitir quetais políticas prosperem, e os Estados são vistos como parte de um bináriode populistas e desafiadores do Direito Internacional, ou democráticos e favoráveis ao internacionalismo liberal. Esta produção acadêmica, portanto,enquanto valiosa, tende a perder relatos mais matizados de coprodução da(i)legitimidade do regime doméstico e ordem internacional como parte de um continuum que não se encaixa em um padrão de narrativa “ou este ou aquele”.Downloads
