Abstract

Workplace sexual harassment is associated not only with individual misconduct but also with the organization of the working environment. This article uses legal analysis, legal comparison, and descriptive statistical analysis of data from 501 employees and 65 employer representatives in Vietnam’s textile and banking sectors to examine enterprises’ responsibilities for preventing workplace sexual harassment under international standards and Korean and Vietnamese law. It hypothesizes that effective prevention and control depend both on the recognition of corporate responsibilities and on their translation into obligations that can be identified, accessed, and fulfilled. The findings show that Korean law establishes specific obligations and mechanisms to ensure implementation, whereas Vietnamese law focuses on internal labour regulations and internal governance. The survey also reveals a gap between the mechanisms enterprises believe they have established and employees’ ability to recognize or access them. On this basis, the article organizes corporate responsibilities into three groups: prevention; receipt of reports; and investigation, response, and remediation.
