Acordo TRIPS: One-size-fits-all?

O presente artigo pretende investigar a adequação e efetividade do modelo padronizado de proteção da Propriedade Intelectual no fomento e difusão da inovação tecnológica e na promoção do balanceamento entre os interesses de produtores e usuários de tecnologia. Para tanto, inicialmente será feita uma incursão histórica que visa recuperar o contexto de inclusão da temática da Propriedade Intelectual na Rodada Uruguai de negociações do GATT. Posteriormente, a partir da análise do texto do Acordo TRIPS e da revisão da literatura especializada, serão identificados os objetivos subjacentes ao acordo e apontados alguns dos inconvenientes decorrentes da adoção do modelo padronizado de proteção da Propriedade Intelectual. Os dados históricos e teóricos coletados serão confrontados com dados empíricos extraídos do Sistema PCT (Patent Cooperation Treaty) e conduzirão à conclusão de que há um conflito entre o modelo de proteção adotado pelo tratado e seus objetivos declarados. Isto porque, a abordagem one-size-fits-all, que prevê um tamanho único de proteção à Propriedade Intelectual que supostamente serviria ao interesse de todos os membros, vem sendo manipulada de forma dissonante dos objetivos que deveriam norteá-la, em prol tão-somente dos interesses dos Estados-membros desenvolvidos e mais especificamente das empresas transnacionais. Visando contribuir para o debate acadêmico e para a maior efetividade do Acordo TRIPS na promoção de seus objetivos, propõe-se uma mudança de olhar sobre o tratado, que já não pode mais ser interpretado como simples mecanismo de comoditização da Propriedade Intelectual, devendo assumir o papel de um sistema internacional de fomento à inovação.Références
