The approach between fi rms for the creation of concentration instruments or business cooperation is, nowadays, an essential element for the development of productive activity. However, antitrust law seeks to regulate such actions, considering that these actions can generate market domination, with the extinction of competition in it. Th e regulation of competition in the market is disciplined in the most diverse regulatory systems. Th us, among others acts, it must be detach the Sherman Act of 1890 (USA) which regulates the subject or the TFEU which regulates the same matter in its article 101. Th ese two legal systems are references even if the fi rst regulates the matter (USA) or it has a current system more eff ective control about business concentration (EU). Finally, it is important to highlight the case of these two systems for analyzing the eff ectiveness of the legal rules in this area.References
