Investimento estrangeiro: o padrão de tratamento justo e equitativo e o papel da boa-fé

A importância do investimento estrangeiro para a economia globalizada tem se refletido na multiplicidade de tratados que buscam protege-lo através de determinados padrões de tratamento, dentre eles aquele denominado tratamento justo e equitativo (fair and equitable treatment). A importância deste trabalho está no fato de que, na tentativa de definir os contornos do padrão de tratamento justo e equitativo, tanto doutrina quanto jurisprudência acabam apenas tangenciando a ideia de boa-fé sem, todavia, estabelecerem claramente a relação entre ambos. O objetivo deste artigo é investigar mais a fundo esta relação, colocando-se a hipótese de que a boa-fé é uma característica do padrão de tratamento justo e equitativo, seja na forma de uma obrigação de proteger as expectativas básicas dos investidores criadas pelos tratados que regulam a matéria, seja como um princípio geral de direito internacional que direciona a interpretação e aplicação desse tipo de cláusula. O método utilizado foi o hipotético dedutivo, partindo-se do estudo doutrinário para a análise de decisões arbitrais relevantes. A conclusão a que se chega é que a exigência de um tratamento justo e equitativo nada mais é que a confirmação da obrigação de agir de acordo com a boa-fé, ou evitar o abuso e a arbitrariedade.References
