Os impactos das tecnologias da informação no fluxo de pessoas: violações da liberdade em um mundo securitizado

Este trabalho aborda as influências das tecnologias da informação e comunicação (TICs) no Estado democrático de direito e delimita-se sobre os algoritmos de big data na construção de mecanismos preditivos que causam efeitos diretos na percepção espaço-temporal e, desse modo, também nas noções de territorialidade estatal. A justificativa deste trabalho existe diante da necessidade de conhecer os elementos que alteram a existência da estrutura governamental. Sua problemática consiste, outrossim, na violação de elemento fundamental da estrutura democrática, os direitos humanos, ocasionada pela fluidez das informações e o controle discriminado de pessoas proporcionado pelo processamento dos mesmos dados mencionados. O valor deste texto reside, portanto, na escassa presença de materiais jurídicos que versem sobre matéria tão minuciosa e essencial para a democracia, uma vez que o fenômeno da coleta massiva de dados envolve todos os setores sociais, da esfera pública à privada. A metodologia utilizada possui natureza de pesquisa aplicada porque discute sobre um problema de forma prática, longe de somente especulações; objetivo exploratório, já que desenvolve e esclarece ideias; e, por fim, utiliza-se, como procedimento técnico, a pesquisa bibliográfica. Com tudo isso, portanto, objetiva-se esclarecer os principais impactos das TICs na vida das pessoas e do Estado, a partir de onde foi possível chegar à conclusão de como acontece a violação aos direitos humanos pelo enquadramento específico das pessoas em determinados nichos a partir do uso dos fluxos de dados.References
