O presente artigo se propõe a examinar os fundamentos jurídicos, a legitimidade e o êxito do Sistema Interamericano de Direitos Humanos. O trabalho se estrutura em seis partes. Na primeira parte, explica como tal sistema recebeu um mandato para promover um constitucionalismo transformador na região. Demonstra que esse mandato se baseia em uma interpretação evolutiva da Convenção Americana de Direitos Humanos, a qual, por sua vez, possibilitou o desenvolvimento de um corpo de direito a que se denomina Ius Constitucionale Commune en América Latina. Na segunda parte, examina a legitimidade social de que goza tal mandato atualmente. Na terceira parte, discorre sobre o Ius Constitucionale Commune em América Latina, demonstrando a sua importância para os avanços alcançados em matéria de direitos humanos. Na quarta parte, define condições e limites para o seu desenvolvimento. Na quinta parte propõe um critério para o exame do êxito do sistema em implementar as transformações a que se propõe na região. Ao final, o artigo traça breves considerações sobre o valor da crítica para o desenvolvimento do Sistema Interamericano.Downloads
