Quem tem medo da responsabilização subjetiva? As teorias da conduta e da imputação, para um direito administrativo sancionador constitucionalizado

O presente artigo busca investigar se há plausibilidade de aplicação da teoria da conduta, originariamente desenvolvida em sede de direito penal, ao direito administrativo sancionador. Partindo-se do método hipotético-dedutivo, notadamente sob a premissa da identidade ontológica entre o delito e a infração administrativa, conclui-se que o atual Estado Constitucional de Direitos, com centralidade dos direitos fundamentais na ordem normativa, desvela uma teoria geral da conduta, para os sistemas de persecução público-sancionadores, a impor a aferição dos elementos de uma imputação subjetiva, como pressuposto da constatação de ilícito.Downloads
