O direito internacional humanitário e a emergência da ciberguerra

Em O Direito Internacional Humanitário e a Emergência da Ciberguerra o autor coloca a questão de partida de saber em que medida a ciberguerra pode (ou deve) ser regulada pelas normas de Direito Internacional Humanitário atualmente existentes. Assim, o principal objectivo do artigo é apresentar um sucinto "state of the art" em matéria de regulação jurídica internacional da ciberguerra. Nele é efetuada uma revisão de literatura, sobretudo norte-americana, pois é aí que a reflexão sobre os seus aspetos legais se encontra mais avançada. A conclusão é a de que, independentemente das eventuais vantagens de um futuro direito convencional da ciberguerra, não estamos perante um vazio jurídico. Todavia, o seu enquadramento legal pelo DIH não está isento de dificuldades sendo talvez a mais notória a atribuição da responsabilidade num ciberataque.Referências
