O Direito Transnacional como um Processo Jurídico - uma Metodologia: um estudo das normas que regem os aspectos processuais da arbitragem

O objetivo deste artigo é analisar a existência de um direito transnacional aplicado às questões processuais que regem o procedimento arbitral. No meio arbitral, há amplo debate sobre a existência de uma ordem arbitral autônoma, uma ordem jurídica transnacional. No entanto, não há discussão específica sobre a aplicação do método transnacional aos aspectos processuais da arbitragem, que é o objeto deste artigo. Parte-se da hipótese de que os aspectos processuais da arbitragem são regidos por um direito transnacional, sendo este entendido por um processo jurídico, uma metodologia que considera uma pluralidade de fontes. A primeira parte apresenta o desenvolvimento do conceito de direito transnacional como uma metodologia tendo como base uma exploração bibliográfica partindo da obra de Jessup e analisando os conceitos desenvolvidos por Vagts (Teoria do Processo Transnacional); Koh (Processo Legal Transnacional); Calliess e Zumbansen (Direito transnacional como proposição metodológica); e Gaillard (Método Transnacional). A segunda parte aplica este conceito de direito transnacional aos aspectos processuais da arbitragem, analisando a pluralidade normativa que é considerada para tomada de decisões processuais na arbitragem e fazendo um estudo de caso de algumas dessas normas. A pesquisa realizada neste artigo teve como foco as arbitragens comerciais internacionais, não englobando as arbitragens de investimento ou arbitragens domésticas. Sob o prisma de uma metodologia transnacional, que analisa as fontes utilizadas para as decisões processuais na arbitragem e a forma de tomada dessas decisões (e não seus conteúdos e códigos), é possível afirmar a existência de um direito transnacional arbitral.References
