REFLEXÕES SOBRE A APLICAÇÃO DO DIREITO DA NEUTRALIDADE NO SÉCULO XXI

Abstract


O presente artigo visa analisar questões relativas à aplicação e vigência do direito da neutralidade atualmente levantadas pelo recente conflito russo-ucraniano. O artigo analisa em especial argumentos apresentados pela doutrina que questionam a compatibilidade do direito da neutralidade com outras regras do direito internacional, sua obsolência devido a alterações nos pressupostos jurídicos da aplicação de suas regras e sua dessuetude em razão de sua não aplicação pelos Estados durante conflitos armados recentes. O artigo conclui que não obstante a significativa redução de sua aplicação em razão de algumas incompatibilidades com outras normas do direito internacional e de sua utilidade ao regular as relações entre Estados em conflito e Estados terceiros, não é possível afirmar que o direito da neutralidade foi extinto ou que não se encontra mais em vigor.
