Direito Internacional Humanitário e as armas autônomas letais

O emprego da tecnologia no conflito militar é uma constante história humana. Com o aperfeiçoamento da cibernética e da inteligência artificial, elas foram incorporadas ao cenário bélico. O objetivo do artigo é analisar a responsabilidade jurídica do comandante militar, no Direito Internacional Humanitário, ao decidir pelo uso de sistemas de armas autônomas letais, ou seja, aqueles dotados de inteligência artificial onde o humano está fora do circuito de controle. O método empregado foi da revisão bibliográfica. Com base em análise da produção acadêmica nacional e internacional, analisou-se o atual estágio de desenvolvimento das armas autônomas, investigando a relação homem-máquina no contexto militar. Conclui-se que o uso de armas autônomas ainda é matéria em aperfeiçoamento na dimensão tecnológica, militar e jurídica, havendo um vácuo de regulamentação internacional sobre o emprego dessas armas. Existem propostas de proibição total ou sua limitação de uso. O Direito Internacional Humanitário, por instrumentos já existentes atualmente, ainda é capaz de dar resposta efetiva para a responsabilização do comandante militar que ordenou a utilização desses sistemas bélicos que tenham produzido danos efetivos, sendo responsabilizado por dolo eventual já que assumiu o risco de produzir tais resultados ao determinar o emprego de tais sistemas de armas.References
