Podemos pensar num Direito Internacional Comparado? Viabilidades e obstáculos na fronteira entre Direito Internacional e Direito Comparado

Resumen


O presente artigo tem como intuito apresentar a possibilidade da formação de um campo autônomo de estudo no Direito: O Direito Internacional Comparado. Neste sentido, apresentamos como hipótese inicial o argumento de que a mobilização conjunta do Direito Internacional e do Direito Comparado contribui não só para a produção de um conhecimento científico diverso daquele realizado por esses campos de forma isolada, bem como rigoroso e crítico. Para confirmar esta hipótese, e adotando uma metodologia analítica e descritiva, investigamos as principais características, métodos de aplicação e perspectivas abertas por estes campos ainda pouco explorado na pesquisa jurídica.
