Como salvar o sistema de repercussão geral: transparência, eficiência e realismo na escolha do que o supremo tribunal federal vai julgar

Os principais tribunais constitucionais e supremas cortes do mundo viram-se, ao longo do tempo, na contingência de criar filtros de relevância para selecionar os processos que irão julgar. No Brasil, desde 2004, tem-se adotado, para esse propósito, o instituto da repercussão geral. A despeito de suas potencialidades, alguns desacertos na sua compreensão e aplicação têm conduzido o sistema ao colapso. O presente artigo, dividido em três partes, representa um esforço para reverter este quadro. Procura-se, assim, apresentar os números que exibem o insucesso do modelo (Parte I), identificar as práticas que tornam o sistema disfuncional (Parte II) e formular sugestões que podem torná-lo viável e eficiente (Parte III). São ideias simples, capazes de transformar o processamento dos recursos extraordinários, independentemente de modificações na Constituição ou nas leis. Basta um indispensável desapego ao que não vem dando certo.Downloads
