A terceira margem do constitucionalismo republicano: uma crítica a Frank Michelman

As décadas de 1980 e 1990 marcaram a hegemonia de uma nova tradição constitucional: o constitucionalismo republicano. Esta tradição, originalmente desenvolvida nos Estados Unidos, pregava o resgate de ideais como bem comum, deliberação cívica e vontade popular por meio de revisão da história e da teoria político-constitucional. Entre os seus maiores expoentes, estava o professor Frank Michelman. Michelman sugere um caminho para se reconciliar, no pensamento e na prática constitucional, o ideal republicano do autogoverno e os limites territoriais e populacionais das democracias. Para superar esse distanciamento entre o ideal de cidadania participativa e os limites da vida moderna, Michelman apresenta a Suprema Corte como a instituição capacitada a assumir e representar, ainda que “simbolicamente”, o princípio do autogoverno. O artigo reposiciona o pensamento de Michelman no contexto intelectual do seu tempo, para, em seguida, endereçar seus limites mais profundos. O principal argumento é de que a primazia conferida pelo autor à Suprema Corte, em vez de realizar o ideário republicano, acaba por neutralizar a capacidade coletiva de perseguir, no pensamento e na prática, aprimoramentos na democracia contemporânea.Referências
